​Terms & Conditions for use of the Gym and facilities

   

• At every visit you must sign in at reception and present your membership card to the staff member. If you do not have your membership card, we may ask to see a second form of ID before you are allowed to enter the gym.

• Opening hours are those stated and you must not enter the gym before these times. Please vacate promptly at closing time.

• Memberships start from the day of induction.

• Payment is required in full and in advance before you are allowed to access the gym.

• All memberships are non-refundable and cannot be refunded.

• The gym is for the use of the Undisputed Gym members only, therefore guests are not allowed.

• During busy periods please limit your time on machines.

• For the health and safety, members must adhere strictly to the following:

  • All free weights are to be returned to the racks after use

  • Cups and mugs are not allowed in the gym

  • Members should bring a small towel to wipe down machinery after use

  • Appropriate clothing and footwear must be worn at all times

  • Offensive language or behaviour will not be tolerated

  • Clashing weights, excessive noise and mistreatment of equipment will not be tolerated

• Anyone under the influence of drugs or alcohol will be ejected and their membership reviewed.

• If for any reason a direct debit fails to credit into our account, membership will be suspended until payment resumes or another payment method is used.

• Undisputed Gym management reserve the right to exclude any member they deem not to be adhering to any of the above or by their own actions poses a health and safety risk to others.

 

     

Terms & Conditions for use of the Children’s zone

    

• For users who would otherwise be unable to attend the gym due to having to look after a child, Undisputed Gym provides a Children’s play area complete with trained personnel to look after your children while you make use of the gym. This service is included in the standard membership price.

• The Children’s zone is only open in selected hours when we have a trained member of staff available to supervise the area. Please ask for details in the gym or see our website.

• Children are not allowed to be around or use any gym equipment, even if they are with an adult. We do not take any responsibility if the child is injured or is involved in any sort of accident in the gym area.

• The Children’s zone is a separate section of the gym with the only access being through a locked safety gate. There is a large viewing area into the Children’s area so you can easily see and hear your child as you do your work out.

• All children must be signed in and out of the Children’s zone.

• If the Children’s zone Is not open when you visit, please speak to a member of staff as we may be able to open it for you if someone is available to supervise the area. You are not allowed to leave any children in the Children’s zone unsupervised.

• If you leave your child in the Children’s zone unsupervised, we do not take any responsibility if the child is injured or involved in any sort of accident.

• You as the parent or guardian of the child, will be held responsible if the child damages any property in the gym.

• You as the parent or guardian of the child, will be held responsible if the child damages any property in the Children’s zone if the area is not under supervision.

• Guardians must be aged 18 or over.

 

    

Terms & Conditions for Classes held at Undisputed Gym

     

• The cost of classes is included in your entrance fee.

• Advance booking for a class can be made at reception.

• Once a class is fully booked, you can put your name down in case there is a cancellation.

• Due to a lack of participants or the unavailability of an instructor, classes can be cancelled at any point.

    

   

 Childrens classes

​

• All children in attendance at a childrens class must have a parent or guardian in the gym at the same time.

• Children must be accompanied and supervised at all times before and after the class by a parent or guardian.

• Children remain the responsibility of their parent or guardian at all times while on Gym premises and their parent or guardian agrees to ensure that each child adheres to the applicable terms, conditions, rules and regulations.

      

 

 

Liability

     

• Undisputed Gym does not exclude or limit in any way their liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by their negligence or the negligence of their employees, agents or subcontractors; or for fraud or fraudulent misrepresentation.

• Undisputed Gym accepts no liability for any loss or damage you may suffer if the failure is attributable to:

  1. The Member’s fault

  2. A third party unconnected with Undisputed Gym’s provision of services under this Agreement

  3. Events which neither Undisputed Gym nor its suppliers could have foreseen or forestalled even if they had taken all reasonable care.

• Undisputed Gym shall not be liable for loss of any money or personal items or loss or damage to your personal property whilst on the premises.

• All Members must take responsibility for their own health and safety at all times. If Members are concerned with a potential injury or accident that may occur during training, then the Member must stop immediately and inform their trainer/instructor.

• Undisputed Gym cannot guarantee transformation results, weight loss, muscle gain or any other type of fitness benefit that it provides in its services. Undisputed Gym can only guarantee the quality of its consultation and work

 

     

Direct Debit Membership

     

• All direct debit memberships are monthly memberships and in this document, when we refer to monthly, this is a calendar month.

• A full calendar month starts on the first day of the month and ends at the end of the last day.

• Your agreement starts from the start date set out at the bottom of this Gym Membership Application Form.

• When you start, you will need to make a one off payment. This payment is a proportion of your monthly fee.

• All direct debit memberships roll monthly from the 1st of every month (or closest working day, if the first falls on a Bank Holiday or Sunday). This initial payment ties you over to the 1st of the month when your direct debit can be called. The payment method can be cash or debit/credit card or direct bank transfer.

• Direct Debit Cancellation - You are responsible for cancelling your direct debit with your bank as the direct debit payments will continue to be taken until you do so. It is also helpful to contact the Undisputed Gym so we can also request that the direct debit is no longer taken, but this does not guarantee that no more payments will be taken.

• Failure to pay. In the event that we are unable to collect your direct debit, your membership will be suspended. If it is the first month of your membership, we will contact you to confirm we have the direct debit set up on the correct bank details.

    

Changes to these Conditions

    

• Undisputed Gym may need to make permanent amendments to these Conditions to ensure the continued health and safety of Members or for operational reasons. Such proposed amendments will be displayed in Undisputed Gym’s premises for a period of 30 days before the amendments are made.
